in california, it is perfectly legal. It has a fixed magazine, doesnt have a folding or colapsable stock, and in order for it to be an assault weapon here in CA, it has to have both a moving stock and a pistol grip, so the capacity is 10 rounds max, as under the Hi cap law of 2000.
